By accessing or using Tamil Biz Directory, creating or managing a listing, purchasing a listing, submitting information to us or otherwise using our services, you agree to these Terms.
If you do not agree to these Terms, you must not use those parts of Tamil Biz Directory that require acceptance of these Terms.
Tamil Biz Directory provides an online platform designed to help users discover businesses, professionals, organisations and services.

Tamil Biz Directory primarily provides a directory, advertising and promotional platform.
A listing on Tamil Biz Directory should not be interpreted as creating a partnership, agency, joint venture, employment relationship or other similar relationship between Tamil Biz Directory and the listed business or professional.
The inclusion of a business, professional, organisation or service on Tamil Biz Directory does not necessarily constitute an endorsement, recommendation or guarantee by Tamil Biz Directory.
Users should make their own enquiries and independently assess whether a particular business or professional is suitable for their needs.
A person submitting a listing must:
We may request information reasonably required to verify your authority or the information contained in a listing.
Listing owners are responsible for the content submitted for their listing.
You are responsible for updating your listing if relevant information changes.
Although Tamil Biz Directory may review, format, edit or moderate listings, the person or organisation submitting a listing remains responsible for the accuracy and legality of the underlying information supplied.
Tamil Biz Directory may, but is not required to, conduct checks concerning information submitted to us. Any review or approval by Tamil Biz Directory does not transfer responsibility for the information from the listing owner to Tamil Biz Directory.
Where a listed professional or business operates in an industry requiring professional registration, licensing, accreditation, permits or insurance, the listed business or professional is responsible for maintaining all requirements applicable to them.
Users should independently verify professional registrations or licences where this is important to their decision. Tamil Biz Directory does not provide legal, medical, financial, accounting, migration, building, engineering or other regulated professional advice merely by listing professionals who offer those services.
Any communication, purchase, booking, quotation, appointment, agreement or other transaction between a user and a listed business is between those parties.
To the extent permitted by law, Tamil Biz Directory is not responsible for disputes arising solely between users and independent businesses listed on the directory. Nothing in this clause excludes any responsibility that Tamil Biz Directory cannot lawfully exclude.
Certain Tamil Biz Directory listings or services require payment. The applicable price will be displayed or communicated before purchase.
Tamil Biz Directory may offer different listing packages or promotional services from time to time.
A paid listing operates for the period identified at the time of purchase.
Unless otherwise stated, a listing period begins when the listing is activated or another commencement date is agreed. The listing may remain subject to editorial review and compliance with these Terms throughout the listing period.
Where a listing is not configured for automatic renewal, we may contact you before or after expiry and offer an opportunity to renew.
Where automatic renewal is offered, the renewal arrangements, applicable price and cancellation method will be disclosed before you agree to automatic renewal. We will not represent that a listing automatically renews unless the customer has been informed of and agreed to that arrangement.
Payments for Tamil Biz Directory services may be processed using Stripe.
By making a payment through our website, you authorise the relevant payment to be processed using the payment method supplied. Stripe may collect and process payment and transaction information in accordance with its own terms and privacy practices. Tamil Biz Directory does not generally store complete credit-card or debit-card credentials. A payment is not considered complete until it has been successfully processed. Where a payment fails, is reversed, disputed or otherwise not successfully received, we may suspend commencement or continuation of the relevant paid service until payment is resolved.

Nothing in this clause prevents a customer from exercising any legal right available to them. Where a payment is legitimately reversed or refunded, Tamil Biz Directory may cease providing the corresponding paid service.

Tamil Biz Directory is not required to provide a refund merely because a customer changes their mind, except where otherwise required by law or expressly agreed. Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

Unless a specific result is expressly guaranteed in writing, promotional activity does not guarantee enquiries, leads, sales, revenue, website traffic, social-media reach, engagement, conversions or any particular commercial outcome. Marketing performance may be affected by factors outside our control.
Tamil Biz Directory provides businesses with an opportunity to increase their visibility.
A listing fee is payment for the agreed directory or promotional service rather than payment for a guaranteed commercial outcome.
Tamil Biz Directory may exercise reasonable editorial control over information displayed on its platform.
Tamil Biz Directory may refuse, suspend, restrict or remove a listing where reasonably necessary, including where:
Where reasonably practicable, we may provide the listing owner with an opportunity to remedy an issue before suspension or removal. Immediate removal may occur where reasonably necessary because of legal, fraud, security or safety concerns.
You retain ownership of intellectual-property rights you hold in content submitted to Tamil Biz Directory.
By submitting content for publication, you grant Tamil Herald Australia Pty Ltd a non-exclusive, worldwide, royalty-free licence for the duration reasonably necessary for those purposes. This licence does not transfer
ownership of your intellectual property to us. Where your listing ends, we will cease actively using your content for future listing promotion within a reasonable period, except where retention is reasonably required for
record-keeping, archived material, prior social-media posts or legal purposes.
By providing content to Tamil Biz Directory, you represent that you own the content or have permission to use and provide it to us.
You must not knowingly provide material that infringes another person’s copyright, trademark, privacy or other legal rights.

We may modify or maintain the platform where reasonably necessary.

We will seek to investigate and respond within a reasonable period. Where a customer has statutory rights under Australian law, nothing in our internal complaints process prevents them from exercising those rights.
A listing owner may request that their listing not be renewed or may request removal of their listing.
Removal of a listing before the expiry of a paid listing period does not automatically create an entitlement to a refund unless Tamil Biz Directory agrees otherwise or a refund or other remedy is required by law.
We may terminate or suspend a service where reasonably necessary because of:
Where appropriate, we will consider whether a less restrictive response is reasonably available. Nothing in this clause affects any refund or remedy that may be required under applicable law.
Tamil Biz Directory may develop, modify or improve its services over time.
Where a change would materially reduce a paid service during an existing paid period, we will have regard to the customer’s contractual and statutory rights.
We may change the price of future listings, renewals or services.
A price change will not retrospectively alter an amount already paid for an agreed existing service unless both parties agree or the law permits it. Where automatic renewal applies, pricing information will be communicated in accordance with the applicable renewal arrangements.
We may update these Terms from time to time.
Updated Terms will be published on our website with a revised ‘Last updated’ date. Material changes will apply prospectively as appropriate and subject to applicable law. Where the nature of an existing paid contractual arrangement means consent to a material change is required, we will seek that consent.
You consent to us communicating with you electronically regarding your account, listing, transactions, renewals, service updates, support, administrative matters and other communications reasonably related to our relationship.
Marketing communications will be subject to applicable law and our Privacy Policy.
Neither party will be responsible for delay or failure to perform an obligation to the extent caused by circumstances outside that party’s reasonable control, except for obligations that cannot lawfully be excluded.
The affected party should take reasonable steps to minimise the effect of the event.
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down where possible.
If it cannot be read down, it will be severed to the minimum extent necessary. The remaining provisions will continue to operate to the extent permitted by law.
If Tamil Biz Directory does not immediately enforce a right under these Terms, that does not necessarily mean the right has been waived.
Any waiver must be clear and applies only to the particular circumstances for which it is given.
These Terms, together with the Privacy Policy, the relevant listing package or order information, any applicable refund or cancellation terms and any other terms expressly agreed between the parties constitute the agreement concerning the relevant Tamil Biz Directory service.
These Terms are governed by the laws applicable in Victoria, Australia.
Subject to any rights a party has under applicable law regarding jurisdiction, the parties submit to the courts and tribunals having jurisdiction in Victoria.
If a dispute arises concerning these Terms or a Tamil Biz Directory service, the parties should first attempt to resolve the matter in good faith.
The parties should allow a reasonable opportunity for the matter to be considered before commencing proceedings, except where urgent relief is required or this would interfere with a statutory right. Nothing in this clause prevents either party from exercising rights under applicable consumer law or seeking urgent legal relief where appropriate.
